Participant expressly warrants and represents that all information submitted in connection with “Lawrence The Fans - Secret Santa” shall be true and correct, and Participant shall not submit any identifying information (e.g., name, email address, mailing address) that belongs to anyone other than Participant. Participant acknowledges and agrees that Participant is submitting Participant’s identifying information (e.g., name, email address, mailing address) freely and voluntarily, and that such identifying information will be shared with other participants for the purposes of carrying out the gift exchange related to “Lawrence The Fans - Secret Santa”, as well as retained by Same Wavelength LLC for mailing list use. Participant expressly warrants and represents that Participant will not publish or otherwise disseminate any other participant’s identifying information (e.g., name, email address, mailing address), in whole or in part, in any manner, and Participant shall use such other participant’s indentifying information solely for the purpose of the gift exchange directly related to “Lawrence The Fans - Secret Santa”. By participating in “Lawrence The Fans - Secret Santa”, Participant releases Same Wavelength LLC and their respective licensees and assigns from any and all claims, damages and/or liabilities arising from or relating to such Participant’s participation in “Lawrence The Fans - Secret Santa”, and agrees to resolve any dispute individually, without resort to any class action, and the Participant agrees that Same Wavelength LLC and their respective licensees and assigns shall not be liable for any loss or injury resulting from participation in “Lawrence The Fans - Secret Santa”, acceptance or use of any gift, or any packaging or other materials related thereto, from downloading any information in connection with participating in “Lawrence The Fans - Secret Santa”, or for technical problems or technical malfunction which may affect the operation of “Lawrence The Fans - Secret Santa”, including without limitation, unauthorized tampering, theft, virus, or destruction of any aspect of “Lawrence The Fans - Secret Santa”, or loss, misdirection, or inaccessibility of an account used in connection with “Lawrence The Fans - Secret Santa”. If for any reason “Lawrence The Fans - Secret Santa” is not capable of running as planned, including infection by computer virus, tampering, technical failures, or any other causes which corrupt or affect the administration, security, or proper conduct of Same Wavelength LLC, Same Wavelength LLC reserves the right, in its sole discretion, to cancel, modify or terminate the “Lawrence The Fans - Secret Santa”. Participant will defend and indemnify Same Wavelength LLC and their respective licensees and assigns from and against, and save and hold each of the foregoing harmless from, all claims, all alleged claims, actions, alleged actions, losses, damages, judgments, liabilities, expenses and costs (including attorney’s fees and costs) resulting from any breach or alleged breach of the foregoing terms and conditions and/or otherwise related to the “Lawrence The Fans - Secret Santa”.
